1. Acceptance of Terms

By accessing and using ColorCraft ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

ColorCraft is an AI-powered platform that enables users to create, design, and export coloring books. The service includes:

AI-generated illustrations and line art
Book layout and design tools
PDF export functionality
Token-based usage system
User account management

3. Age Requirements

If you're under the age required to manage your own account in your jurisdiction (typically 18 years old), you must have your parent or legal guardian's permission to use ColorCraft. Please have your parent or legal guardian read these terms with you.

If you're a parent or legal guardian, and you allow your child to use the services, then these terms apply to you and you're responsible for your child's activity on the services, including any purchases or content generated.

4. User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Providing accurate and complete information
Notifying us immediately of any unauthorized use

5. Token System and Payments

ColorCraft operates on a token-based system:

Tokens are required to generate AI images and content
Tokens can be purchased through our payment system
Token purchases are non-refundable unless required by law
Unused tokens do not expire but may be subject to future policy changes
We reserve the right to modify token pricing with reasonable notice
Image Generation Policy: All image generations and AI content creations are final. Once tokens are consumed for generating content, no refunds or free replacement tokens will be provided, regardless of your satisfaction with the generated result.

5a. Free Trials

ColorCraft may offer time-limited free trials of paid subscription tiers (for example, the "Creator" tier). When you start a free trial:

The trial duration and any included token allocation are disclosed during the signup flow before you confirm the trial.
You authorize ColorCraft (through our payment processor, Stripe) to charge the payment method on file at the end of the trial period unless you cancel before the trial ends.
The trial converts automatically to a paid subscription at the then-current rate for the selected tier. The renewal price is shown during trial signup and again in your account on the Tokens and Billing page.
If a payment method is required to start the trial, your card may be authorized at trial start for verification purposes. Authorization holds are released by your card issuer per their normal policy.
A trial used and cancelled by the same account does not entitle that account to additional trials of the same tier.

5b. Subscriptions and Auto-Renewal

Paid subscriptions renew automatically on the monthly billing date until cancelled. You will be charged the then-current subscription rate, plus any applicable taxes, on each renewal date. We will not change the renewal rate without prior email notice to the email address on your account.

You can review your subscription status, billing cycle, next charge date, and next charge amount at any time on the Tokens and Billing page in your account. Failed renewal attempts will be retried per Stripe's standard dunning schedule before the subscription is suspended.

5c. Cancellation and Refunds

You may cancel a paid subscription or a free trial at any time through either of the following channels:

The Tokens and Billing page in your ColorCraft account, which opens the Stripe customer portal where you can manage or cancel the subscription directly.
By emailing support@colorcraft.ai from the email address on your account. Email cancellations are honored as of the timestamp of the email; we will confirm cancellation in writing.

Cancellation takes effect at the end of the current billing period. You retain access to paid features through that period. Free trials cancelled before the trial end date will not be charged.

Refunds: Subscription fees are non-refundable except where required by law or at ColorCraft's discretion. Token balances are not refundable in cash but remain available in your account through the end of your billing period. Token spend on image generations is final per Section 5; we may at our discretion issue goodwill token credits in cases of system failure or service error.

Chargebacks: Filing a chargeback with your card issuer instead of contacting us directly is not a substitute for cancellation, but we will process the chargeback per Stripe's standard process and cancel the associated subscription. We may suspend accounts with unresolved chargeback activity.

6. Third-Party AI Services and Responsible Use

ColorCraft integrates with third-party artificial intelligence vendors to provide image generation services. By using our service, you acknowledge that:

Your prompts and generated content may be processed by third-party AI providers.
You must use AI generation features responsibly and ethically.
You may not attempt to generate content that violates our prohibited uses policy.
We reserve the right to monitor and restrict AI usage that violates these terms.

Responsible AI Use: You agree to use AI generation features in a responsible manner, including not attempting to generate harmful, illegal, or inappropriate content. We may suspend or terminate accounts that violate these responsible use guidelines.

7. Intellectual Property Rights

Your Content: You retain ownership of content you create using our Service.

AI-Generated Content: Content generated by our AI systems becomes available for your use under a license that allows you to use, modify, and commercially distribute the generated content.

Our Service: The ColorCraft platform, software, and underlying technology remain our property.

8. Prohibited Uses

You may not use our Service:

For any unlawful purpose.
To violate any international, federal, or state regulations.
To infringe upon our intellectual property rights or the rights of others.
To harass, abuse, insult, harm, defame, or discriminate.
To submit false or misleading information.
To attempt to reverse engineer our systems.

9. Dispute Resolution and Arbitration

Any disputes shall be governed by the laws of the State of California. Any dispute, claim, or controversy shall be determined by arbitration in the State of California.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually.

10. Limitation of Liability

To the fullest extent permitted by applicable law, ColorCraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

11. Service Availability

We strive to maintain the Service but cannot guarantee uninterrupted access.

12. Modifications to Terms

We reserve the right to modify these terms at any time. Continued use of the Service after any such changes shall constitute your consent to such changes.
